What are the Rules and Regulations?

The Rules and Regulations explain and implement the provisions of the CC&Rs.  Rules and Regulations are organized into three main categories: Architectural Guidelines, Association Rules, and Policies and Procedures.

The Rules and Regulations are a part of our overall Governing Documents that, in addition to the Rules and Regulations, include the CC&Rs, Bylaws, and Articles of Incorporation.  For a more detailed explanation of the Governing Documents, please see the link below.

Categories of Rules and Regulations:

• The Architectural Guidelines are created and implemented by the Architectural Committee in accordance with Section 5.10 of the CC&Rs.  The Architectural Guidelines define classes of changes made to individual Lots that are “Visible From Neighboring Property” as defined in the CC&Rs for which the Architectural Committee has provided “prior written approval” as required by the CC&Rs, and they also define other similar or related classes of changes that require formal request and approval before the changes can be made  The Architectural Guidelines operate with the Architectural Review Process and through the Architectural Request form.

  The three principal parts of the Architectural Guidelines are:

  • Architectural Guidelines (Revised 8/16/2008)

  • Architectural Request Form (two versions - Revised 8/16/2008):

  • Computer Form (Microsoft Word - Fill out online, then print, sign and submit to the Community Manager)

  • Paper Form (PDF - Print and complete, sign and submit to the Community Manager)

  In addition to these documents, the Oakwood Lakes Community Association has implemented an Official Exterior Paint Color Palette that is to be used for repainting homes in colors other than the original colors or previously approved color scheme.  The Paint Palette is documented in a book that is located in the offices of the Association's Community Manager, and use of the Paint Palette is defined in the Architectural Guidelines.  Representative illustrations of the color schemes and instructions for their use are also found on the Paint Palette page.

• The Association Rules are created and implemented by the Board of Directors in accordance with Section 5.3 of the CC&Rs.  They implement behavioral items that are mandated by the CC&Rs.

  The three principal documents that comprise the Association Rules are:

  • Association Rules (Revised 1/16/2007)

  • Meeting Rules of Conduct (Adopted 4/18/2006)

  • Board of Directors Rules of Conduct (Adopted 4/18/2006)

• The Polices and Procedures are developed by the Board of Directors in accordance with the CC&Rs and Bylaws.  They establish the methods used by the Association to enforce the Rules and Regulations, and to perform other activities that are mandated by the CC&Rs.  Some of the Polices and Procedures also include the use of various Forms.

  On June 19, 2002, the Board of Directors adopted a general policy for the enforcement of rules.  On September 19, 2006, with the assistance of the Association's legal counsel, the Board of Directors adopted an enforcement method that eliminated the previous policy and its associated schedule of fines in favor of a policy that would have unresolved violations turned over to the Association's legal counsel to achieve compliance.  A letter announcing the new enforcement method was mailed to homeowners on May 4, 2007.

  The Association's Policies and Procedures include the following:

  • Association Enforcement Policy Resolution (Adopted September 19, 2006)

  • Association Records Review Request Resolution (Adopted February 3, 2003)

  • Violation / Parking Complaint Form (two versions):

  NOTE:

  Please complete the entire form.  Incomplete complaint forms will not be processed.  Per Arizona law (A.R.S. § 33-1242 and A.R.S. § 33-1803), any complaint lodged with the Association will NOT remain anonymous.  The person complaining of the alleged violation must state their first and last name and this information will be sent, if requested, to the member who is accused of the violation.
